Posted: 11:56 am PST November 9, 2006Updated: 12:08 pm PST November 9, 2006

Two men have been arraigned on felony cruelty to animals and gun possession charges in connection with the fatal shooting of an ostrich on Halloween night, according to the San Mateo County district attorney's office.

Timothy McKevitt, 19, and Jonathon Porter, 20, allegedly were drinking that night and trespassed onto a ranch south of Half Moon Bay in order to look at the ostriches there, according to the district attorney's office.

When a surprised ostrich attacked and injured the men, they ran off, later returning with a rifle and a shotgun and allegedly shooting and killing the ostrich, according to the district attorney's office.

The owner of the ranch was able to track down the men and reported the crimes to authorities.

The men were later taken into custody by the San Mateo County Sheriff's Office.

At their initial arraignment, McKevitt and Porter pleaded not guilty to the crimes and are scheduled to appear in San Mateo County Superior Court for a review conference on Nov. 15 and a preliminary hearing on Nov. 21.

McKevitt and Porter remain in custody in lieu of $25,000 bail.
