Sex Offender Arrested After Visiting Morgan Hill School

A registered sex offender was arrested Wednesday after he was recognized on the grounds of a Morgan Hill elementary school, according to Morgan Hill police.

At approximately 10:40 a.m., Morgan Hill and San Jose police arrested Daniel Duran, 41, after a judge issued a warrant for his arrest for being on the campus of Nordstrom Elementary School on March 21 without lawful business, according to police.

A maintenance worker at the school recognized Duran after the incident when he saw Duran's picture in a Morgan Hill newspaper a week later.

The article had named Duran as a registered sex offender visiting realtors and inquiring about purchasing a home.

The maintenance worker contacted the reporter who covered the story who then contacted police, according to Morgan Hill police.

Communities were made aware of Duran after he visited a realty office on March 21. Duran's behavior was so unusual that the realtors looked him up on http://www.meganslaw.ca.gov. Upon seeing Duran's picture on the Web site the realtors notified police.

Around the same time, Pleasanton police were distributing a news release about Duran after similar incidents in Pleasanton.

Pleasanton police Lt. Darrin Davis said last week that in one incident, Duran was seen walking around a home for sale in downtown Pleasanton about 10 p.m. and looking through windows.

Davis said that in another incident, Duran confronted a woman walking down the street and asked her about homes for sale in the area.

Duran also told the woman that she was beautiful and that beauty is a sin, according to Davis.

When Duran was told that his behavior was making people uncomfortable he said that it was not illegal to go to open houses, according to Mountain View police.

Duran had also been approaching homes and asking if cars in the driveways were for sale, despite the fact that the cars were not listed for sale.

On Tuesday police attempted to arrest Duran at his home but he was not there. Wednesday he was arrested at his San Jose home on Leeward Drive without incident and booked into Santa Clara County Main Jail on $6,000 bail.

"We would not have been able to arrest this guy without the complete cooperation of several groups, including the media, Pleasanton (police), and the community at large," Morgan Hill police Commander David Swing said. "This is one of the finest examples of community involvement I have seen."

Duran was convicted in 1988 of rape by force or fear and in 1999 he was convicted of assault to commit a felony sexual act, according to police.
