Jury Chosen In Case Of Pregnant Mother Killed In Landis Crash

An illegal immigrant accused of driving drunk and killing a pregnant woman in Landis will be put on trial Tuesday.

Jury selection in the case began early Monday and by mid-afternoon all 12 jurors -- a group of seven women and five men -- had been selected. They will determine whether Rigo Verto Guillen Martinez is guilty of several charges, including second-degree murder and driving while impaired. He pled not guilty in March.

Authorities say Guillen-Martinez, 33, was speeding to elude a Kannapolis police officer when he crashed head-on into 20-year-old Leeanna Newman’s car on South Main Street on February 6. Newman, who was eight-months pregnant, and her unborn child died, but her toddler survived.

Guillen-Martinez broke both his legs in the crash. He limped into the Rowan County Superior Court room on Monday clean-shaven and wearing khakis and a white button-down shirt.

His attorney said what happened on February 6 won’t be disputed, but he’ll argue that it’s not grounds for a murder conviction.

Newman’s family has been outspoken about the fact that Guillen-Martinez was not charged in the unborn baby’s death. For them the trial couldn’t come soon enough.

“This all happened in February, and we’re really glad it’s getting started so we can finally have justice for Leeanna, and have it over,” said Jeanette Bentley, Newman’s aunt.

She and other members of the family wore little angel pins to court to represent Leeanna. They are purple – the young mother’s favorite color.

Guillen-Martinez was not charged in the unborn child’s death because the law states that a baby that never takes a breath outside the womb is not classified as a person. Newman’s family has been fighting for legislation to recognize the rights of unborn babies.

This case was able to get to trial so quickly because another murder case that was scheduled to be tried this week was pushed back, and both sides were ready in this case, so they decided to take the date.
