Judge Expected To Rule Monday On SF Triple Murder

A San Francisco Superior Court judge is expected to rule Monday on whether a suspected gang member must stand trial on murder charges in the gunfire slaying of a father and two sons last year.

Testimony in the preliminary hearing of Edwin Ramos, 22, of El Sobrante, ended today after nine days of proceedings in the court of Judge Teri Jackson at the Hall of Justice.

Jackson will hear arguments from prosecution and defense attorneys Monday morning on what evidence she should consider and after that is expected to rule on whether Ramos must face a trial.

Ramos, a suspected member of the MS-13 street gang, is accused of murdering Anthony "Tony" Bologna, 48, and his sons Michael, 20, and Matthew, 16, as they sat in their car at an intersection near their home in the Excelsior District of San Francisco on June 22, 2008.

Police have speculated the shooter mistook the Bolognas, who were on their way home from a Sunday picnic in Fairfield, for members of a rival gang.

Ramos, who worked as a warehouseman at an auto parts store in South San Francisco, has admitted to police he was the driver of a Chrysler 300 from which the fatal shots were fired, according to testimony by police Inspector Tom Newland earlier this week.

But he has maintained the shooter was another man, Wilfredo Reyes, nicknamed "Flaco," who according to Ramos was a passenger in the car.

Defense attorney Gayle Gutekunst told Jackson today, "Our position is that Mr. Ramos was not the shooter."

A third Bologna son, now 19, who survived the shooting, has identified Ramos as the gunman in descriptions to police, in a photo lineup last year and in court last week.

The only witness called by the defense in the preliminary hearing was Newland, who was recalled to the stand by Gutekunst this afternoon for the purpose of giving more details about Ramos' statement to police last year about Reyes' alleged role.

The judge said she would allow the expanded testimony because it could be relevant to two gun charges pending against Ramos. But she noted that even if he is not proved to be the shooter, Ramos could be found liable for murder if he is proved to have aided and abetted the crime.

Under questioning from Gutekunst, Newland extended his left arm from the witness chair to demonstrate Ramos' description of how Reyes allegedly held the gun in his left hand, held it out the window on the driver's side of the car and fired.

Ramos gave his statement to police on June 25, 2008, hours after being arrested at his El Sobrante home.

Newland today also repeated his earlier testimony that police searched for Reyes at his San Francisco home on June 27, 2008, but did not find him.

He said he was told by people at the house that Reyes had moved out earlier that week. He said he doesn't know where Reyes is now, but said police are continuing efforts to find him.
